In Canada:
• Egg/sperm donation & surrogacy are legal.
• The Assisted Human Reproduction Act prohibits anyone from:
      • paying a person to act as a surrogate, or to donate eggs, sperm or embryos.
      • receiving payment for arranging, offering to arrange, or advertising to arrange, the services of a surrogate.
• Those who break the law face significant fines and jail time.
• Donors and surrogates can be reimbursed for genuine, receipted, out-of-pocket expenses incurred in relation to the donation or surrogacy. This does not include loss of work-related income except where a qualified medical practitioner certifies in writing that there is a risk to the surrogate’s health. Health Canada is currently developing regulations for allowable expenses.
•  Surrogacy contracts may not be enforceable: there is no law pertaining to such contracts and their enforceability has yet to be tested in a Canadian court.
